Refund policy
BÓM BEAUTY REFUND & RETURNS POLICY
At Bóm Beauty, we want you to feel confident when purchasing our products. This Refund & Returns Policy explains when products purchased through the Bóm Beauty online store may be returned, exchanged or refunded.
This policy applies to purchases made through our online store and is governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (“CPA”), as amended.
Nothing in this policy limits, excludes or waives any rights you may have under applicable South African law.
1. RETURNS OF UNWANTED PRODUCTS
Because our products are cosmetic and personal-care products, we take hygiene and product safety seriously.
For hygiene and safety reasons, Bóm Beauty does not accept returns of cosmetic or personal-care products that have been opened, used, tested or otherwise tampered with, unless the return is required because the product is defective, unsafe, damaged on delivery, incorrect, or otherwise does not comply with the CPA.
Where permitted by applicable law, an unopened and unused product may be considered for return provided that:
- the product has not been opened or used;
- the product remains in its original packaging;
- all labels, seals and product components remain intact;
- the product is in a resalable condition; and
- the return request is made within the applicable period permitted by law.
The cost of returning an unwanted product will be the customer's responsibility unless the return is due to a defect, damage, incorrect product, or another circumstance where applicable law requires Bóm Beauty to bear the cost.
2. DEFECTIVE, UNSAFE OR POOR-QUALITY PRODUCTS
Under the Consumer Protection Act, consumers have an implied warranty that goods supplied will meet the applicable standards of quality, be safe and be reasonably suitable for their intended purpose.
If a product is defective, unsafe, or fails to meet the applicable requirements of the CPA, you may contact us to arrange a return.
Bóm Beauty will assess the reported issue and provide the remedy required by applicable law.
Normal product characteristics, reasonable variations in colour, texture or appearance, or a result that differs from an individual's expectations will not automatically constitute a defect.
3. PRODUCTS DAMAGED DURING DELIVERY
If your order arrives damaged, please contact Bóm Beauty as soon as reasonably possible after delivery.
Please provide:
- your order number;
- photographs of the damaged product and packaging; and
- a brief description of the damage.
We may request the product to be returned so that the condition of the product can be assessed.
Where the product was damaged before or during delivery and applicable law requires a remedy, Bóm Beauty will provide the appropriate remedy in accordance with the CPA.
4. INCORRECT PRODUCT OR INCOMPLETE ORDER
If you receive a product that is different from the product you ordered, or an item is missing from your order, please contact us as soon as possible after delivery.
We will investigate the issue and, where the error is attributable to Bóm Beauty, arrange the appropriate correction, replacement or refund.
5. PRODUCTS THAT CANNOT BE RETURNED
Subject to your rights under applicable law, the following products cannot ordinarily be returned because of their personal-care and hygiene nature once opened or used:
- opened cosmetic products;
- used hair-care products;
- opened oils, mists or other topical beauty products;
- products that have been contaminated or altered after delivery; and
- products returned without their original packaging where the packaging is reasonably necessary to establish the condition, safety or authenticity of the product.
This does not affect any statutory right to return a defective, unsafe or otherwise non-compliant product.
6. CHANGE OF MIND
A change of mind does not automatically create a right to a refund.
However, certain transactions may be subject to statutory cancellation or cooling-off rights under South African law, including rights that may apply to transactions resulting from direct marketing or other circumstances specifically provided for by the CPA.
Where a statutory cooling-off or cancellation right applies, Bóm Beauty will honour that right in accordance with the applicable legal requirements.
7. SALE ITEMS AND PROMOTIONAL PRODUCTS
Sale, discounted and promotional products are subject to the same statutory consumer rights as other products.
A product cannot be excluded from a consumer's statutory rights merely because it was sold at a discounted price.
Where a sale or promotional product is defective or otherwise qualifies for a statutory remedy, the applicable remedy will be determined in accordance with South African law.
8. HOW TO REQUEST A RETURN
To request a return, please contact Bóm Beauty using the contact details provided on our website.
Please include:
- your full name;
- order number;
- date of purchase;
- product(s) concerned;
- reason for the return; and
- photographs or other supporting information where relevant.
Please do not send products back without first contacting us and receiving return instructions.
9. RETURN INSPECTION
Returned products may be inspected to determine the condition of the product and the nature of the reported issue.
This inspection does not remove or restrict any rights you may have under the CPA.
A return may be refused only where permitted by applicable law, including where a product has been opened or used in circumstances where no statutory return right applies.
10. REFUNDS
We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method within 10 business days. Please remember it can take some time for your bank or credit card company to process and post the refund too.
If more than 15 business days have passed since we’ve approved your return, please contact us at info@bombeauty.co.za.
11. EXCHANGES
Where appropriate and permitted by law, Bóm Beauty may offer an exchange or replacement.
Where a product is defective or otherwise subject to a statutory remedy, the available remedy will be determined in accordance with the CPA and the consumer's applicable statutory rights.
12. SHIPPING COSTS FOR RETURNS
Where a return is required because of a defective, unsafe, damaged or incorrectly supplied product, Bóm Beauty will bear the applicable return or collection costs where required by law.
For an unwanted product or change-of-mind return where a return is permitted but no statutory right requires Bóm Beauty to bear the cost, the customer may be responsible for the return shipping cost.
13. OUR LEGAL OBLIGATIONS
This policy is intended to operate alongside, and not instead of, the Consumer Protection Act 68 of 2008 and other applicable South African legislation.
Nothing in this policy is intended to:
- exclude or limit a consumer's statutory rights;
- exclude Bóm Beauty's statutory obligations;
- waive any remedy that cannot lawfully be waived; or
- prevent a consumer from exercising a right available under applicable law.
If any provision of this policy conflicts with a mandatory provision of South African law, the applicable law will prevail.
